END USER LICENSE AGREEMENT

This End-User License Agreement ( " EULA "), subscribing to the game Taikodom, refer to the computer program including documentation , physical enviroments, "on-line"printed material, offered by HOPLON INFOTAINMENT S/A, a Corporation under Brazilian Law located in Florianópolis, Santa Catarina, Brazil. While installing, copying, making the download, or playing Taikodom, the User must commit to the EULA and terms linked to this. If you do not agree on the terms and conditions in the EULA, you can not install, copy, download or use Taikodom in any form.

1. GENERAL CONSIDERATIONS

  1.1. Users are identified and granted access to Taikodom after registering, either using the form available at the site WWW.TAIKODOM.COM or the one in the game client. The data provided are personal and non-transferable , and should be by all means right, non-questionable and exclusively answering to the End-User.

  1.2. Users shall choose a username and a password, hereunder called the "Password", which will jointly be the personal non-transferable identification of each user account.

In order to create the above-mentioned account, Users will be required to fill out a registration form with personal information in an absolutely confidential character. This account will be deemed activate after the User follow instructions sent to the email address provided during registration to activate.
Once the correct information is provided, an user account will have been created granting Users access to Taikodom On-line for a period of time to be determined by HOPLON.

Inactive User accounts may be removed from the Taikodom user database after a period of (a) 3 (three) months of continuous inactivity, if the account has not been activated by folllowing the above-mentioned steps, or (b) 12 (twelve) months of continuous inactivity if the account was activated.

  1.3. Full access to the game features and complete support of Users activities may need payment of access credits, whose prices will be posted at WWW.TAIKODOM.COM, where the means of payment will also be established. Access credits acquired by Users, unless and expressly stated otherwise , are valid for one year and non-reimbursable.

Hoplon reserves the right to offer Users partial access to the game and limited support of their activities for free, with no warranties attached, reserve the right to cease such access at any time, with an advance notice of 15 (fifteen) days.

User account removal by Hoplon, whether because of user request, inactivity or banning, implies: (i) cancelation of user access pendeing credits, as well as the credits in use, even if still valid, without reimbursement by Hoplon, (ii) exclusion of user account data, including characters, and (iii) release of distinctive and/or exclusive elements of the user, such as username, character names and their appearances.

In case of punitive banishment, on behalf of the game community, Hoplon reserves the right to save some of information of Users with the intent of preventing them to regain access by creating another account.

  1.4. For your benefit, 14 (fourteen) years old Users should assisted by parents or people in charge during the registration and when filling out the contract.

2. LICENSE CONCESSION

By this EULA, Hoplon concedes Users, without exclusivity, and without time limit, the right to install and use multiple copies of Taikodom in several computers, as long as all terms and conditions described in this EULA are properly carried out by them.

  2.1. Taikodom will be considered in use when loaded in the temporary or permanent memory of a computer.

  2.2 Users declare to be aware that using Taikodom requires access to the Internet. Hoplon will be exclusively responsible for the maintenance of a massive game server that allows Users participation in a game environment where several users play simultaneously (multiplayer). The license granted by this EULA does not include rights and obligations resulting of Users participation in such game multiplayer environment. Such rights and obligations are available at Hoplon's Taikodom website, and are considered to be accepted by Users simply by accessing and using Taikodom.

  2.3. Hoplon authorizes Users to grant devices access and use of their licensed copy of Taikodom, with the exclusive objective of receiving maintenance services and technical support.

3. COPYRIGHT

Taikodom (including any images, photographies, animations, videos, sounds, songs and texts incorporated to the same) is protected by law and international copyright treaties and intellectual property. The trademarks "Taikodom ", " Hoplon ", and trademarks incorporated to the universe Taikodom, belong and can be exclusively used by Hoplon, not granting rights to Users of any commercial trademark of products or services contained in the game and environment Taikodom. All the rights related to intellectual property referring to Taikodom, such as the ones outlined above belong to Hoplon or its suppliers.The User declares being aware that all interventions in Taikodom , including dialogues, situations, images, blue-prints, sounds and/or any other actions and / or creations of the User, relating to the on-line environment, as well as all incidents on Taikodom, are thought as being an integrant part of the game and property of HOPLON INFOTAINMENT S/A. Hoplon holds all the rights except those expressly granted to Users in this EULA

4. GRANTING OF LICENSE FOR MEDIA ELEMENTS.

Taikodom holds the right of including photographies, images, videos, texts, animations, sounds, songs, videos and any media element, identified in Taikodom for the use and / or modification by the User "Media Elements " * (a) selling, licensing, distributing or using/reproducing copies of the Media Elements if not inside Taikodom; * (b) displaying obscene contents, or similar to these out of Taikodom according as defined by Brazilian Law. If the User infringes any of the terms here established, this will be responsible exclusively for the consequences eventually resulting from such acts * (c) pursue activities contrary to Brazilian and international legislation. Hoplon holds the right of canceling the User's account if he/she violates the rights of others according to the Brazilian and international legislation.

5. LIMITATIONS ON USE

Users may not: (i) effectuate any reverse engineering, translation, modification or decompilation, developing derivations and imitations of Taikodom, or perform any other act whose intent is to access the source code of Taikodom; (ii) lease, rent, sell, sublicense, lend or provide by any legal means, the game Taikodom or any of its parts; (iii) to reproduce, total or partial contents from Taikodom for his/her own profit. Taikodom is licensed as a single product, and components can not be separated and utilized for any other purpose other than its original.

6. PERMISSION FOR USE OF PERSONAL DATA

By accepting these terms The User allows Hoplon to collect and use the technical information supplied by Users and compiled as part of in-game activities and support services eventually given to users and related to Taikodom. Hoplon can use these information for business purposes and for improving the products or supplying services and technologies personalized for Users. Hoplon will not release, grant access or divulge such information in a way that allows Users to be identified personally. Use and storage of these information will be carried out according to Hoplon's Privacy Policy, available at WWW.TAIKODOM.COM, which hereunder becomes intrinsic with this contract.

7. TERMINATION OF EULA

Without damaging any other right, Hoplon is able to rescind this license if the User does not comply with these terms and conditions. In this case, Users may also lose the granted license and shall destroy all Taikodom copies, and components related to the same game.

8. INTEGRAL CONTRACT AND DIVISIBILITY

This EULA (including any corrections or addends provided by Taikodom) constitutes the integral agreement between Users and Hoplon regarding Taikodom, services and components related to that, the support services (if existent), prevailing over any communications, proposals and oral representations, or previous and posterior writings relating to Taikodom or any subject here brought up by this EULA.

If the terms of any regulation or software used by Hoplon conflict with the contract, the terms of this EULA must prevail.

If any arrangement of this EULA is considered null, invalid, ineffective or illegal, the remaining clauses will maintain its validity and full efficiency.

9. HOPLON WARRANTY

Users are aware that: (i) Taikodom is intended and is offered as a product for general use, not aiming the satisfaction of particular situations of any user, (ii) no computer programm is free of bugs, (iii) the User is responsible for creating backup copies of archives, being exclusively responsible for any losses, accidental or causal removal of Taikodom. Since the User possess a valid license, Hoplon guarantees: (i) Taikodom will fulfill its functions in accordance with the written materials that accompany it for 90 (ninety) days from date the license of use and/or access right was received and (b) any services related to technical support supplied by Hoplon will have to be available to Users according to what was described in the material, and support engineers of Hoplon will put their greatest efforts, cares and technical skills to solve any problem that may appear. If Taikodom does not live up to its duties here listed, Hoplon will take the following measures, at its own criteria: (a) repair or substitute Taikodom, (b) refund subscription fees or (c) grant proportional discount on the price of the product. This guarantee is null and has no effect if the bug in Taikodom result from accident, abuse or misuse, including those in discordance with the details of this EULA. Substitution of Taikodom will be guaranteed during the period of the initial term of the 30 (thirty) days warranty.

10. EXCLUSION OF ANY OTHER TERMS AND CONDITIONS

Except if specified in this EULA , and if allowed by law, Hoplon and its suppliers exclude any other additional warranty for Taikodom besides the one here specified, it grants such warranty through conditions and / or terms, of oral or written, definite or implicit form (any other form is by legislation, common right, bilateral or any agreement and including, not limited implicit marketing, adaptation to a specific end, authorship and rights violation) It is excluded specially, but not solely, the inadequacy of Taikodom, of technical documentation and of manuals that follow Taikodom, for a determined application or specific purpose of the User.

11. LIMITATIONS ON RESPONSIBILITY

The User recognizes and accepts that, under no circumstances, Hoplon and / or its suppliers will be responsible for any damages (including, not exhaustively, the indirect, special damages, incidents or consequences, the profits resulting from business interruption, loss of confidential information or similar to that, for personal damages, non fulfillment of any obligation, including negligence and losses of any nature, including the ones done in subjective or objective good faith, and negligence), and other financial damages resulting from the use or the impossibility of using Taikodom, even when Hoplon has been warned about the possibility of such damages and losses. In any case, though the present term is judged to be invalid or null through judicial measures, Hoplon and suppliers commit to attain exclusively to the values, services and terms proposed in this EULA. The User is aware that the limitations of responsibility informed are used in the price composition of the User license offer.

12. TECHNICAL DOCUMENTATION AND MANUALS

The technical documentation and manuals related to Taikodom, comprising the description of the proceedings for its installation and use, are available at WWW.TAIKODOM.COM. In case Users have any doubts about this EULA, or wish to contact Hoplon for whatever reason, the user should visit the Taikodom website at WWW.TAIKODOM.COM

The terms in the license respond to the laws established in Brazil. By means of this instrument both parts are in accordance with the terms here listed.

Terms and Conditions on Use of Hoplon - Taikodom Services

1. General conditions:

1.1. All individuals who, via website or Taikodom game client, register for use of its products or services (User) must mandatorily, before use of such products is started, accept the terms and conditions on use of Hoplon - Taikodom described in this document.

1.2. Before accepting the Terms and Conditions it is indispensable the reading of it in its totality. After acceptance, the User shall print or keep a local copy of the Terms and Conditions, for self control.

1.3. To accept the Terms and Conditions it is required to click in the "accept" icon or effectively make use of the Services. In the latter, the User is aware and accepts that Hoplon-Taikodom will take for granted the use of Services as an acceptance of the Terms and Conditions.

1.4. It is forbidden from using services and accepting the Terms and Conditions: (a) minors without the allowance of parents or tutors, or (b) any person prohibited from receiving the Services as defined by Brazil's Laws or any other Countries', including the Country where they reside or the Country from where they use the Services.

1.5. This Terms and Conditions is embedded in a document called EULA (End User License Agreement) also available at the website and Taikodom game client, concerning the use of products and services offered by Hoplon.

2. On user obligations for service use

2.1. The User cannot abuse, threat or harass other users or Hoplon-Taikodom representatives, including voluntary moderators. Such prohibition includes, but it is not limited to:

(A) The act of "spamming"
(B) Excessive postage of tickets or e-mailing,
(C) Prevent GMs (GameMasters, members of Hoplon support team who audit and guide Users' activities within the online universe of Taikodom game, and at websites, forums, tools, and other associated issues) from doing their works or not following the instructions supplied by Hoplon-Taikodom staff.

2.2. The User may not use any abusive, defamatory, ethnically or racially offensive, harassing, harmful, hateful, obscene, offensive, sexually explicit, threatening or vulgar language in texts, images or names. Any attempt of masking or hiding the fact is a reason for a rescission of the Terms and Conditions, resulting in User expulsion.

2.3. The User cannot use the "Role-playing" (character interpretation) as a subterfuge to break any rule of conduct established on this clause.

2.4. The user cannot permit to be identified as any member or representative of Hoplon-Taikodom.

2.5. The User cannot alter any item or any art or part of websites, servers or any other virtual environment of Hoplon-Taikodom.

2.6. The User cannot interfere, neither carry out reverse engineering, in the information flux between the server and the User.

2.7. The User shall respect the Brazilian law, including what refers to illegal activities according to Brazil's criminal legislation, thus avoiding illegal and abusive acts.

2.8. The User commits to keep an acceptable behavioral pattern, being prohibited from making use of obscene language, or any other form of pornography.

2.9. The User commits to not taking advantage from any bug, understood as any fail or defect in software or game rules, found in Taikodom and use it against other users. The User shall not communicate the existence of any exploitable bug to others directly or through a public forum. All bugs should be reported through the bug reporting tool on our website or by email to suporte@hoplon.com

2.10. The User shall not use Taikodom as a tool of promotion and marketing practice of any illicit, illegal and/or pirate products.

2.11. The User shall not attempt to play Taikodom on any server that is not controlled or authorized by Hoplon.

2.12. It is expressly prohibited the creation, adaptation, and use of any emulator, or yet any kind of utility for services offered by Taikodom-Hoplon.

2.13. It is expressly forbidden to the User to announce, negotiate, suggest, or yet make any kind of statement with the objective of selling, changing accounts and/or items of products and services by Hoplon-Taikodom for real money.

2.14. The User shall provide correct and real information for the register and Game Account creation.

2.15. The User commits to not getting involved, release and make publicly available any activities that might come to interfere with the correct functioning and processing of services by Hoplon-Taikodom; as well as making illegal use, or rip off any other service offered by Hoplon-Taikodom. This includes, but is not limited to, releasing privative information by Hoplon-Taikodom in chat channels, or any other public channel, by virtual or real means, specially, concerning information about bugs found.

2.16. The User shall not get involved in any activity that raises difficulty or maintenance costs of services by Hoplon-Taikodom.

2.17. All contact exchanged between users and Hoplon-Taikodom employees, representatives, colligates, service suppliers, are covered by a confidentiality clause, and shall not be published or revealed to public knowledge.

2.18. Hoplon-Taikodom reserves the right to block temporarily or permanently any User's access without a previous warning, in case there is suspicion of breaking of rules established by Terms and Conditons, or Brazilian laws. Furthermore, we reserve the right to delete all User accounts or items if necessary.

2.19. Hoplon-Taikodom reserves the right to ban any User in case of suspicion of any violation, without refund or compensation.

2.20. In case it is required by Justice or official means, Hoplon-Taikodom will also terminate all User accounts.

2.21. In case the subject activity of this Terms and Conditions is characterized as illegal, Hoplon-Taikodom, without any advance notice, will terminate all existing accounts.

3. Diverse Content

3.1. The Services offered by Hoplom-Taikodom may include hyperlinks to other Internet sites, contents or resources. Hoplon-Taikodom does not possess control over any other sites and resources that are provided by companies or people apart from Hoplon-Taikodom.

3.2. The User is aware and agrees that Hoplon-Taikodom is not the responsible for the accessibility of any external site or resources, as well as it does not support any announcements, products and other materials embeded or available at such Internet sites or resources.

3.3. The User is aware and agrees that Hoplon-Taikodom is not responsible for any loss or damage that may incur as a result of the availability of such Internet external sites or resources and downloads, or as a result of any expectation put in itself by the nature, precision or existence of any advertisements, products or other materials, present or available in such Internet sites or resources.

4. Site modifications and updates.

4.1 Hoplon-Taikodom reserves the right to change or interrupt, temporarily or permanently, its products and services, or part of them, to perform maintenance and updates when needed, without an advance notice. Hoplon-Taikodom will ensure the biggest efforts to keep these maintenances and updates predictable, warning Users as soon as possible.

4.2. Hoplon-Taikodom reserves the right to keep specific and recurring dates and hours for periodic maintenance, daily or weekly, as normal and regular part of Taikodom, as well as make changes in these dates and hours, with wide advance notice to Users.

5. Term Alterations

5.1. Hoplon-Taikodom can oprate changes in the Terms and Conditions periodically. When these changes are performed, Hoplon-Taikodom will produce a new copy of the Terms and Conditions that will be put available at www.taikodom.com/avisoslegais.

5.2. The User comprehends and agrees that using the Services posteriorly to the alterations on the Terms and Conditions, will be take as an acceptance of the updated Universal and Additional Terms.
